I don't think he got banned either. But why would he be retarded for coming back to the game? Admin isn't active, he hasn't been banned since logging back on. He got caught and didn't get penalized, seems perfectly reasonable for him to start playing again.

yeah, he was never banned, he just went inactive. nothing ever stopped him from playing, as far as i know.
