You can bust people anytime you want, even at lvl 1 but you are limited by your level for the max time you can try.

If I get busted I seem to be more successful if I wait a minute before trying to bust out but what Thor says is correct.

I find it easiest to bust people out right before the guards shift change.

i find its best when you click the button that says bust out for 25 credits
that or when you do a strip tease for the gay guard who does the graveyard shift who also has a thing for hairy men. he just cant get enough
