I'm not staff but.... If the gang has no points, you can't get PVP points from them. PVP's are 'stolen' points.
The victor always gets some number of points for dropping the hideout. I don't know if the exact formula is published, but it seems to be based on the levels of the players in the losing gang and the condition of the hideout at the time the war started. I don't know if there are other factors.
So the short answer is yes, you always get hideout points, but only get PVP points if they have points to take.
